1. What LogoKit is

LogoKit is an AI-powered logo generation service. You provide brand information, we generate logo options using AI. You can purchase a Logo Pack to download and use your chosen logo.

2. Free tier

• You can generate up to 6 logo previews per project (3 rounds of 2)
• Previews are for evaluation only — you may not use, download, or distribute free-tier logos commercially
• We reserve the right to limit generation volume to prevent abuse

3. Purchases

• Logo Pack costs $65 (one-time payment)
• Payment is processed by Stripe
• After purchase, you receive full commercial rights to the logo you selected
• All sales are final — no refunds, as the product is digitally delivered

4. Ownership & license

• Before purchase: Generated logos are previews only. You may not use, download, or distribute them commercially.
• After purchase: You receive a perpetual, worldwide, non-exclusive license to use the purchased logo for any commercial purpose — websites, products, social media, print, merchandise, etc.
• You may not resell, sublicense, or redistribute the logo as a standalone asset (e.g., on stock marketplaces or as design templates).
• LogoKit retains the right to use generated logos in marketing materials (e.g., "made with LogoKit" showcases) unless you request removal.

5. AI-generated content & disclosure

LogoKit uses artificial intelligence to generate logos. Specifically:

• Anthropic Claude writes logo design prompts based on your brand input
• Recraft V4 generates logo images from those prompts

You should be aware of the following:

• No copyright guarantee: Under current U.S. law (as affirmed by the Supreme Court in March 2026), purely AI-generated works may not be eligible for copyright protection. If you significantly modify the logo (e.g., editing, combining elements), your modifications may qualify for protection.
• Trademark is separate from copyright: You can still register an AI-generated logo as a trademark. We recommend consulting a trademark attorney before filing.
• Uniqueness not guaranteed: AI models may produce similar outputs for similar inputs. We cannot guarantee that your logo won't resemble existing designs.
• Your responsibility: You are responsible for checking trademark databases (e.g., USPTO TESS) before using your logo commercially to ensure it doesn't infringe on existing marks.

6. Indemnification

You agree to indemnify and hold LogoKit harmless from any claims, damages, or expenses arising from your use of a generated logo, including but not limited to trademark infringement claims. LogoKit does not provide legal advice and is not responsible for verifying the originality or trademark status of generated logos.

7. Acceptable use

You agree not to:

• Abuse the service (automated scraping, excessive generation)
• Use LogoKit to generate offensive, illegal, or misleading content
• Reverse-engineer the API or circumvent usage limits

8. Refund policy

All sales are final. Because the product is digitally delivered immediately after purchase, we do not offer refunds. If you experience a technical issue preventing delivery of your Logo Pack, contact us and we will resolve it.

9. Service availability

LogoKit is provided "as is". We don't guarantee 100% uptime or that generated logos will meet your expectations. We may modify or discontinue the service at any time.

10. Limitation of liability

To the maximum extent permitted by law, LogoKit's total liability is limited to the amount you paid for the service.

11. Changes

We may update these terms. Continued use of LogoKit after changes constitutes acceptance.
